Federal Judge Orders an Injunction Against St.Bernard Parish

New Orleans,Louisiana,April 4,2008 – At 2:38 PM on April 3rd United States District Court Judge Sarah S. Vance ordered a Temporary Restraining Order and Preliminary Injunction against the St. Bernard Parish Council for Your Home Solution Management LLC,and their clients. This action was supposed to bring immediate relief to Your Home Solution,their homeowner clients, and the tenants who occupy the newly renovated homes. The tenants faced continuous efforts by the Parish to evict them and their children out into the street. The Parish is ordering the local utility companies to disconnect services to homes being rented without a permissive use permit, and threatening the management company, the homeowners,as well as the tenants with $250 per day fines, and jail time.

In spite of the court order, officials from St. Bernard Parish continue to harass the tenants in the rented homes. The Parish is increasing it’s efforts to rid the renters from the Parish despite being ordered to restrain from enforcing or implementing against Your Home Solution,and their clients.

Rodney Brenneman managing Partner for Your Home Solution Management, says his office was flooded with calls the day after the court order, from distraught tenants who continued to receive threats from the Parish, eviction notices and demands that they move out in ten days.Brenneman goes on to say,” I know the adverse impact the Parish’s strong armed behavior has had on our business. I can only imagine the anguish our tenants live with; to loose everything in the storm, and begin to find hope as they were starting over again in their new homes, to now having to live with the constant fear of being homeless, and having to endure the relentless harassment from the Parish.

The court order only gives relief to the parties named in the suit.Brenneman says,” YHS Management is accepting new property management clients, who would like to rent their properties. We have such a need for rental housing in the Parish.”YHS continually receives request from FEMA, to help house those families being displaced from their FEMA trailers.

Brenneman offers, that his company really has been a solution for many investors who planned to sell their newly remodeled homes, but could not due to the severe change in the mortgage industry, and also with displaced families who can not qualify for a mortgage, leaving rental homes as their only option.

Brenneman’s attorney, Henry L. Klein of New Orleans, stresses the strength of their case. This ordinance by St.Bernard Parish is “intimidating,irrational,oppressive,and indefesible.Klien explains,”it’s unconstitutional to overregulate rental housing to the extent that it strips homeowners of their property rights. Klein states,” the ordinance is so restrictive that it represents a public seizure of property rights without compensation.

Thanks for posting the results Rodney. All of us who have interests in that area are feeling the pinch of the parish's heavy handed way of trying to keep their city segregated.
